Is Justice Amy Coney Barrett Going Liberal? Some Conservatives Seem to Think So

Is Justice Amy Coney Barrett shifting left? At least one conservative law professor seems to think so.

Josh Blackman, one of the most conservative legal scholars out there, recently argued that Barrett’s slide to the left is unmistakable. He pointed to her recent votes, including:

USAID funding case, where she didn’t side with conservatives

EPA water protection case, where she sided with the liberals

Blackman wrote:

“I wrote about this years ago, and people are slowly starting to see it. I don’t think she’ll go full David Souter, but at best, she’ll be like Justice Sandra Day O’Connor or Justice Felix Frankfurter—focused on judicial restraint rather than ideology.”

Translation: She’s not going to be a rubber stamp for the Trump administration or conservative litigants. And for some conservatives, that’s a problem.
